Terms & Conditions

OFFER PERIOD: Offer begins at 9:00 a.m. Eastern Standard Time (“EST”) on August 13, 2024, and ends at 11:59 p.m. EST on September 30, 2024 (“Offer Period”).

ELIGIBILITY: Offer open to athletes and Para athletes who are legal residents of the United States who competed on behalf of the U.S. in Paris in 2024 on an official U.S. team roster (“Athletes”). Employees of Mattress Firm, Inc. (“Sponsor”) and all of their respective parent/affiliated companies, divisions, distributors, suppliers, and advertising/promotional/judging agencies associated with this offer (collectively, “Sponsor and Promotion Parties”) and each of their immediate family members (defined as parents, spouses, siblings and children; whether biological, adopted, step or in-law) and persons living within the same household as such employees (whether related or not) are not eligible to receive the Offer.

OFFER: Mattress Firm is offering all Athletes (as defined above) a Sleepy’s by Sealy Premium Foam Mattress in the size of their choice (the “Offer”). Approximate Retail Value of Offer: $2,049.99 – $2,999.99, depending on mattress size. The Offer is available until 9/30/24. Limit of one (1) Offer per Athlete.

HOW TO RECEIVE THE OFFER: If you are an eligible Athlete, visit MattressesforChampions.com during the Offer Period and follow the on-screen instructions to complete an Offer request. You will be required to provide your Name, Address, Email Address, Phone Number, Sport in which you competed, Instagram handle, X handle and/or TikTok handle and your preferred mattress size. Once the on-line Offer request is submitted, you will be contacted via the email and/or phone number supplied on your request within ten (10) business days and will then be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) and any other ​​requested documents within five (5) business days from the date the documents are received, or the Offer may be forfeited.

If an Athlete is a minor (under 18-years-of-age) in his/her/their state of residence, the Offer may be claimed by the minor’s parent or legal guardian, who must sign and return all required documents. If any potential Athlete is (i) disqualified, found to be ineligible or not in compliance with these Terms and Conditions; (ii) declines to accept the Offer once documents are requested; or (iii) does not return the required documents as stated above, the Offer may be forfeited. Upon verification of eligibility, mattresses will be shipped to the athletes at the physical addresses (P.O. Boxes are not permitted) provided at the time of Offer acceptance within eight (8) to ten (10) weeks, or as soon as administratively feasible. Athletes (or parent or legal guardian who accepted Offer on behalf of minor Athletes) shall be solely responsible for payment of any and all federal, state, and local taxes, and for any other fees or costs associated with the Offer, regardless of whether it, in whole or in part, is used. The Athletes, or parent or legal guardian of a minor Athlete, will be required to provide Sponsor with a valid social security number or tax identification number before the Offer is awarded, for tax reporting purposes. Athletes, or parent or legal guardian of a minor Athlete, will be issued an IRS 1099 tax form for the retail value of the mattress received. Any difference between stated approximate value of mattress and actual value of mattress will not be awarded. All other costs and expenses not expressly set forth herein shall be solely each Athlete’s responsibility. Sponsor is not responsible for any undelivered e-mails, including without limitation, e-mails that are not received because of an athlete’s privacy or spam filter settings which may divert any Offer e-mail, including any Athlete notification e-mail, to a spam or junk folder. Offers that are unclaimed, or returned as undeliverable may not be awarded, in Sponsor’s sole and absolute discretion. Offers are non-transferable and no Offer substitution, exchange or cash equivalent will be allowed, except by Sponsor, who reserves the right to substitute an Offer of equal or greater value, in the case of unavailability of the mattress or force majeure, at Sponsor’s sole and absolute discretion. Neither Sponsor, nor the Promotion Parties shall be held responsible for any delays in awarding the Offer for any reason. Mattresses will only be delivered to addresses in one of the fifty (50) United States or the District of Columbia. (P.O. Boxes are not permitted).

Your submittal of an Offer request constitutes your representation of eligibility, consent to participate in Offer and consent for Sponsor to obtain, use, and transfer your name, address, and other information for the purpose of Offer administration.

LIMITATIONS OF ​LIABILITY​ AND RELEASE: No liability or responsibility is assumed by Sponsor, the Promotion Parties, or any of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising agencies, representatives, and agents (“Released Parties”) resulting from participation in or attempt to participate in the Offer or inability to upload or download any information in connection with the Offer. No responsibility or liability is assumed by Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Offer: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; errors or limitations of any Internet or wireless service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or the Website; unauthorized human or non-human intervention of the operation of the Offer, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Offer or loss, miscount, misdirection, inaccessibility or unavailability of an e-mail account used in connection with the Offer. Released Parties are not responsible for any printing, typographical, technical, computer, network or human error which may occur in the administration of the Offer or these Terms & Conditions or in any Offer-related materials. Use of Website is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer or Web-enabled device resulting from participation in the Offer.

RELEASE OF LIABILITY: By accepting the Offer, participants agree (a) to release Sponsor and the Released Parties from any and all claims, damages or liabilities arising from or relating to such participation in the Offer; (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Offer, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By accepting an Offer, recipients agree that the Released Parties will have no liability whatsoever for, and shall be held harmless by participant against, any liability for injuries, losses, or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Offer or from acceptance, possession, or use of the Offer. Products delivered to participants may not be returned and do not qualify for any guarantees, replacements or exchanges other than in accordance with applicable manufacturer’s warranty terms.

GENERAL: All information submitted online by participant is subject to, and will be treated in a manner consistent with, Sponsor’s Privacy Policy accessible at: https://www.mattressfirm.com/privacy-policy.html. By participating, you agree (i) to be bound by these terms and conditions and the decisions of Sponsor which are final and binding, and (ii) to release and hold harmless Sponsor, their respective parent companies, affiliates, subsidiaries, divisions and/or advertising or promotion agencies, individuals or entities responsible for the development, printing, distribution and implementation of this Offer, against any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from participation in this Offer. Offer is subject to all applicable federal, state, and local laws. If electing to participate in the Offer using a wireless device, entrants are solely responsible for any such wireless charges. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer and/or wireless device related to or resulting from participating in this Offer or downloading materials from or use of the Website.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS OFFER OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MATTRESS FIRM, INC. WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND MATTRESS FIRM, INC. AND IT’S RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Persons who tamper with or abuse any aspect of the Offer, as solely determined by Sponsor will be disqualified. Should any portion of the Offer be, in Sponsor’s sole opinion, compromised by bugs, virus, worms, non-authorized human intervention or other causes, which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or submission of information, Sponsor reserves the right at its sole discretion to cancel, suspend or terminate the Offer.
